Is it legal to post a position that is already filled (my position is posted and says in anticipation of open)?

I am working at a school- I also know that they dont have 2 openings- have been working for 3 weeks- just wondering if it is legal to post my position when I haven't been fired (or even formally disciplined for that matter). The posting is for my job, but says in anticipation of vacancy.
